Terms and Conditions for UK Orders

About these Terms

These terms apply to any order placed on the Merchant’s website that is shipped from outside the United Kingdom to an address in the UK or from outside Northern Ireland to an address in Northern Ireland (“Qualifying Order”). They add to, and where necessary override, the Merchant’s existing terms for Qualifying Orders.

Sale structure

When you place a Qualifying Order, you are buying the goods from Day Technologies Ltd trading as Duty Refunds (“Duty Refunds”). At checkout the Merchant first sells the goods to Duty Refunds, who immediately sells them on to you.

Your payment details, delivery address and any other information needed to complete the order will be shared with Duty Refunds and its service partners.

The Merchant processes your payment as agent for Duty Refunds. Title to the goods passes from Duty Refunds to you once payment is approved.

Pricing and errors

If a price or description error occurs, Duty Refunds may correct the error or cancel the order and refund all payments made.

Delivery

Certain addresses (for example PO boxes) are not eligible for delivery.

Items may be dispatched in one or several shipments. You will only be charged for items actually shipped.

Duty Refunds may refuse or cancel any order at its sole discretion.

Customs clearance

You authorise Duty Refunds and its agents to act as your direct representative for customs purposes, including filing declarations, amending commodity codes and paying or recovering duties and taxes.

Payment, currency and fraud prevention

You can pay in any currency shown at checkout. Exchange rates are fixed at the time of purchase.

Duty Refunds uses fraud prevention tools and may void any transaction that fails authentication.

Returns and refunds

Questions or complaints should be raised with the Merchant first. The Merchant handles returns in line with its policy and on Duty Refunds’ behalf.

Where a return is accepted, risk and title pass straight back to the Merchant. The Merchant will issue a credit note to Duty Refunds, who will then refund you.

You authorise Duty Refunds to recover any import duties or taxes on returned goods and agree to sign any documents reasonably required.

Data privacy

Your personal data will be processed by the Merchant, Duty Refunds and their service providers to fulfil the order, in line with their respective privacy policies.

Compliance

You are responsible for ensuring that importing the goods into the UK (or Northern Ireland) is lawful.

Electronic communications

By placing a Qualifying Order, you consent to receive communications from Duty Refunds electronically.

Changes to these terms

The version displayed at checkout applies to your order. If you do not agree, do not complete the purchase.

Severability

If any term is unenforceable, the remaining terms continue in force.

Governing law and jurisdiction

These terms and any dispute arising out of them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.

Definitions

Merchant – the website on which you place the order.

Product(s) – the goods included in your Qualifying Order.

Qualifying Order – any order placed on the Merchant’s website that is:

  • shipped from outside the United Kingdom to an address in Great Britain (England, Scotland or Wales); or
  • shipped from outside Northern Ireland to an address in Northern Ireland.
